LAS CRUCES, N.M. - Las Cruces Police have arrested three roommates police suspect of raping a heavily intoxicated 22-year-old woman this past weekend.
Cody Gregory Highfill and Roberto Balderrama, both 19, and 21-year-old Stephen Moleres were arrested over the weekend and charged with one count each of criminal sexual penetration – aiding or abetting. The charges are second-degree felony counts.
On Saturday, Oct. 12, Las Cruces Police were sent to Memorial Medical Center where a 22-year-old woman was receiving medical attention for what was said to be a sexual assault that occurred at The Grove apartments on E. Union Ave.
According to police, late Friday evening the 22-year-old woman was drinking alcohol with Highfill and Moleres at their apartment when she became heavily intoxicated.
Police say that during the early-morning hours of Saturday, Oct. 12, all three men allegedly took part in sexually assaulting the intoxicated woman.
Later that morning, Highfill carried the woman to her apartment in the same complex and allegedly forced himself onto her again, police said.
More than one witness told detectives that the woman was clearly intoxicated and appeared to be too drunk to consent to such activity.
Balderrama and Moleres were arrested Saturday while Highfill was served with a warrant Sunday evening. All three were booked into the Dona Ana County Detention Center with bonds set at $20,000 each.
