EL PASO, Texas -- The trial for 34-year-old Fabian Hernandez continued Tuesday as prosecutors questioned a woman who dated Hernandez after he separated from his wife.
Prosecutors say Hernandez shot and killed his wife, 28-year-old Renee Urbina Hernandez, and her 24-year-old boyfriend Arturo Fonseca in front of an Upper Valley home in November 2006.
ABC-7 archives show Hernandez and Urbina Hernandez were married but separated.
Caroline Martinez said she met Hernandez about three weeks before the murders. She said the night before the murders, they spent the night together and went out to a bar.
On the day of the murders, she said she dropped Hernandez off at his father's house about 6 p.m. She then took his mother and sister, who were at Hernandez's father's house, to their home.
Martinez said later that day she heard from Hernandez's sisters when they were looking for their brother.
Martinez testified that she received a call from Hernandez. She said Hernandez told her, "If they ask 'where was I?' tell them I was with you."
She said she responded, "It's a little too late already. I already told them you weren't."
Martinez also said Hernandez called her for a ride to a mutual friend's house, where she noticed "a lump" in front of the house, which turned out to be a car covered with blankets.
Martinez said Hernandez asked to borrow her phone to call one of his sisters. During the phone call, he cried and said "poor kids of mine" in Spanish, Martinez said. She said Hernandez also called the family of Urbina Hernandez, though she could not elaborate on what was said since defense attorneys kept objecting on grounds of hearsay.
Martinez later met with police during their investigation into the murders.
Before the trial broke for lunch, a firearms expert with the Texas Department of Public Safety testified how he tested the suspect's gun with three casings from the scene and found they were a match.
The jury was sent home just after 1:30 p.m. Tuesday. Court officials said it is because the prosecution is waiting for two witnesses to be available to testify.
Hernandez is charged with capital murder, and prosecutors are seeking the death penalty.
