On Monday the U.S. Supreme Court refused to hear an appeal from an El Paso man convicted of murder, the Associated Press reports.

Thirty-seven-year-old Rigoberto Avila was sentenced to death for stomping his girlfriend's baby to death in 2000.

He told police he was jealous of the time his girlfriend spent with 19-month-old Nicolas Macias.

A date for Avila's execution has not been set.

Two other Texas death row inmates also had their appeals refused Monday, according to the Associated Press.
